AGREEMENT OF SALE
Please read carefully
The use of this site is governed by the TERMS AND CONDITIONS AGREEMENT OF SALE set forth below. Your use of this site or purchase from Addict Tackle indicates your acceptance of these terms and conditions.
Addict Tackle reserves the right to make changes to this web site and these terms and conditions at any time without any prior notice.
Addict Tackle is the service provider; it is also referred to as “Addict Tackle”, “us” and “we”.
Customer is the person or organisation who purchases or seeks services from Addict Tackle; it is also referred to as “you”.
PLACING ORDERS
All orders placed are subject to confirmation and acceptance by Addict Tackle.
Addict Tackle may vary prices for received orders in the event of price changes. We will advise you if this is the case.
To minimise errors and improve efficiency, orders should be placed using our on-line ordering system whenever possible. Other forms of ordering are accepted only if our on-line ordering system is malfunctioning or you have difficulty using it. Other ordering methods include E-mailing our sales email or submitting order by phone. For some organisations where a purchase order is necessary, we still encourage the orders to be placed on-line and followed by a summarised purchase order.
Quantity in stock does not take into account the orders already placed which are yet to be processed. It is possible that an order placed earlier will receive the allocation of the part in which the quantity for it showed as in stock at the time of your order. Inventory discrepancy can also affect the accuracy of the stock status displayed on our web site.
Any attempt to cancel an order must be made as soon as possible. Cancellations attempted after the despatching will result in the customer having to pay the shipping and handling charges on the package and the cost of shipping the package back.
Cancellations may be communicated by email or phone.
DISCOUNTS / DISCOUNT CODES
Unless specified otherwise via communication mediums such as email, SMS & social media, automatic and checkout code discounts, including Fishing Addiction member discount, only apply to items not already discounted / on sale.
GIFT VOUCHERS, DISCOUNT CODES AND PROMOTIONAL CAMPAIGNS
Any orders paid for wholly or in part with gift vouchers or discount codes do not qualify for any running deals, sales or promotions. Addict Tackle reserve the right to change this rule at any time entirely or on a per campaign basis. All sale campaigns are for a duration of one week unless explicitly stated in campaign materials.
PRICE MATCH GUARANTEE
We will need to verify that our product is identical to that of our competitors. The product must be accessible from an Australian retailer, must be in stock and not on pre-order. Competitor shipping costs for the product is taken in to consideration when we are assessing price matches.

Show one of the staff in-store our competitor's ad or website with the lower priced item. They will then go through your request and validate it.

Send an email to admin@addicttackle.com.au with the product specifics as well as the lower-priced item from our competitor's ad or website. We will then evaluate and verify your request before getting back to you.

Call us on (07)5523 3535 and provide us with the product specifics as well as the details of our competitor's ad or website with the lower pricing item. Then we'll verify and provide a way to facilitate the sale.
What exactly qualifies?
To price match, your product must be identical to our stocked item, which includes:
- brand
- model number / sku
- colour
- advertised by the supplier
- be in stock and readily available from the competitor longer than 7 days.
Our price match policy does not apply to the following goods or situations:
- Cashback or coupon offers
- Commercial quantities and associated pricing.
- Stock liquidations or clearance pricing.
- Quotes or privately invoiced pricing.
- Past orders which have already been processed.
- Products that are only available from the competitor in store only.
- Products listed for sale on marketplaces (eg Ebay etc)
Occasionally there will be prices that we just can't match, but we will endeavor to give you the best price possible.
PAYMENT
For on-line orders, accepted payments include credit cards (Visa, Mastercard, Amex), Paypal, Apple Pay, Google Pay, Zip Pay, After Pay.
Addict Tackle reserves the right to perform checks for orders paid using credit card, and we may request photo identification to be supplied for large value orders.
The title of the goods supplied does not pass to the customer from Addict Tackle until the full amount is paid.
SHIPPING
We do not ship to third party addresses unless that address is known and can be verified by Addict Tackle.
Customers are responsible for paying any freight charges incurred by refused shipment and unclaimed goods. Addict Tackle will make every effort to deliver on time.
Customers are responsible to have someone at the delivery address to sign for and accept the delivery. Cost for re-delivery attempts may be passed to the customers if the delivery address is unattended at the time of delivery.

RETURN AND REFUND
Returns for refund will only be accepted within 7 days of you receiving the goods. Returned goods must be in its original condition and include all the original packaging. Shipping and handling cost are not refundable. This return for refund policy is not applicable for change of mind, and lack of expertise for use of product.
Any incorrect, missing or damaged items received must be reported to Addict Tackle within 24 hours of you receiving the delivery.
If item(s) received is not what was ordered please do not open the sealed package in which it was sent. Any attempt to use the incorrect item will be deemed to be acceptance by the customer of the item(s) as a satisfactory substitute for the one that was ordered and no further claim can be raised thereafter.
Addict Tackle owns the title of any extra goods shipped with your order that have been despatched in error.
RETURN OR REFUND OF GIFT VOUCHERS
Promotional Vouchers are not redeemable for cash.
WARRANTY CLAIM
All goods sold by Addict Tackle come with a warranty to be free from any defects or faults. This warranty is not transferable.
Goods under warranty cover will be replaced or repaired by the manufacturer. No refund can be provided under any circumstances.
Warranty only covers the item(s) sold by Addict Tackle.
A large percentage of returned goods are found to be, not faulty. If the returned goods are determined by Addict Tackle to not be faulty, then all returning shipping fees will be worn by the customer. We will seek the permission from the customer to charge this cost to the customer’s credit card where possible. Failing this, the goods will be sent back by Australia Post COD freight collected. Addict Tackle also reserves the right to charge the labour cost for examining these goods where no fault was found.
All warrantees are voided if returned product is found in any way to be mishandled, misinstalled, modified, tampered, abused, physically damaged.
Please attach a copy of the original invoice or provide the original invoice number. A detailed fault description sheet must be sent together with all the returning warranty goods.
Customer is responsible for any shipping and insurance cost involved in sending the warranty claim goods back to Addict Tackle.
Addict Tackle is not responsible for any parcel missing in transit, on its return back to Addict Tackle.
KNIVES, BLADES, BOWS, ARROWS & WEAPONS
You must be 16 Years old or over to purchase any knife (including mulit-tools with knives), blade or bow and/or arrows. If purchasing these items, accepting the Terms & Conditions is certifying that you are over the age of 16.

SMS/MMS Mobile Message Marketing Program Terms and Conditions
Addict Tackle (hereinafter, “We,” “Us,” “Our”) is offering a mobile messaging program (the “Program”), which you agree to use and participate in, subject to these Mobile Messaging Terms and Conditions (the “Agreement”). We may modify or cancel the Program or any of its features without notice. This Agreement is limited to the Program and is not intended to modify other Terms and Conditions or Privacy Policy that may govern the relationship between you and Us in other contexts. We may also modify this Agreement at any time and your continued use of the Program following the effective date of any such changes shall constitute your acceptance of such changes.
The Program allows Users to receive SMS/MMS mobile messages by opting into the Program, such as through online or application-based subscription forms. Your consent to receive automated marketing text messages is not required as a condition of purchasing any goods or services. Regardless of the opt-in method you used to join the Program, you agree that this Agreement applies to your participation in the Program. If you have opted in, the Program provides updates, alerts, information, promotions, specials, and other marketing offers (e.g., product discounts) from Addict Tackle via text messages through your wireless provider to the mobile number you provided. SMS/MMS mobile messages may be sent using an automated telephone dialing system or other technology. Message frequency varies. You are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.
If you do not wish to continue participating in the Program or no longer agree to this Agreement, you agree to reply STOP to any mobile message from Us in order to opt-out of the Program. You may receive an additional mobile message confirming your decision to opt-out. You understand and agree that the preceding options are the only reasonable methods of opting out. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out.
For any questions please text "HELP" to the number you received the messages from. You can also contact us for more information. If you wish to opt-out please follow the procedures above.
We may change any telephone number we use to operate the Program at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Program are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. You agree to maintain accurate, complete, and up-to-date information with us related to your receipt of messages, including, without limitation, notifying us immediately if you change your mobile number.
You agree to indemnify, defend, and hold us harmless from any third-party claims, liability, damages, or costs arising from your use of the Program or from you providing us with a phone number that is not your own. If at any time you intend to stop using the mobile telephone number that has been used to subscribe to the Program, including canceling your service plan or selling or transferring the phone number to another party, you agree that you will complete the Opt-Out process set forth above prior to ending your use of the mobile telephone number. You understand and agree that your agreement to do so is a required part of these terms and conditions. You further agree that, if you change your telephone number without notifying Us of such change, you agree that you will be responsible for all costs (including attorneys’ fees) and liabilities incurred by Us, or any party that assists in the delivery of the SMS/MMS mobile messages, as a result of claims brought by individual(s) who are later assigned that mobile telephone number. This duty and agreement shall survive any cancellation or termination of your agreement to participate in any of our Programs.
You agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Program, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
You may not use or engage with the Platform if you are under thirteen (13) years of age. If you use or engage with the Platform and are between the ages of thirteen (13) and eighteen (18) years of age, you must have your parent’s or legal guardian’s permission to do so. By using or engaging with the Platform, you acknowledge and agree that you are not under the age of thirteen (13) years, are between the ages of thirteen (13) and eighteen (18), and have your parent’s or legal guardian’s permission to use or engage with the Platform, or are of adult age in your jurisdiction. By using or engaging with the Platform, you also acknowledge and agree that you are permitted by your jurisdiction’s Applicable Law to use and/or engage with the Platform.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

DISCLAIMER
Due to changing market forces and other extenuating circumstances that affect product availability, and price stability we reserve the right to withdraw any product we advertise and change prices without notice.
